Agreement

By accessing or using the Hungry Express website, mobile apps, and services (the “Services”), you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

You must be 18+ or have parental consent where required.

Our Service

Hungry Express enables customers to order from independent restaurants, stores, and couriers (“Vendors” and “Riders”).

We are a platform; Vendors and Riders are independent parties, not our employees or agents.

Availability, menus, prices, and delivery times are set by Vendors and may change.

Your Account

You are responsible for your account credentials and all activity under your account.

Provide accurate information and update it as needed (name, phone, delivery addresses, payment methods).

We may suspend or terminate accounts for suspected fraud, abuse, or violations of these Terms.

Orders, Pricing & Payments

An order is an offer to purchase; it is accepted when a Vendor confirms. Some orders (e.g., custom items) may be non-cancellable once confirmed.

Prices, fees (e.g., delivery, small order, service), and taxes are shown at checkout.

Payments are processed by PCI-DSS compliant providers; we do not store full card details.

If payment fails or is reversed, we may suspend fulfillment and/or your account until resolved.

Deliveries and Pick ups

Delivery windows are estimates; traffic, weather, and Vendor/Rider capacity can affect timing.

You must be available to receive the order at the address provided; failed deliveries may incur a fee.

Age-restricted items (if any) require valid ID at delivery—otherwise the order may be cancelled without refund.

Changes, Cancellations, and Refunds

Before Vendor acceptance, you may cancel in-app, where available. After acceptance, changes and cancellations may be limited.

If items are unavailable, we’ll follow your replacement preferences or cancel and refund the unavailable items.

If something is wrong (missing/incorrect/quality), contact support within 24 hours with your order ID.

We’ll investigate with the Vendor and offer a fair remedy (refund, credit, or redelivery) where appropriate.

Vendors & Riders

Vendors are solely responsible for menu accuracy, food safety, allergens, and compliance with applicable laws.

Riders are responsible for safe and lawful delivery. Report concerns via Support.

Acceptable Use

Do not:

Misuse the Services (e.g., reverse engineer, overload, scrape, or bypass security)

Create multiple accounts to abuse offers.

Submit false claims, reviews, or chargebacks.

Harass Vendors, Riders, or support staff.

Use the Services for unlawful purposes.

Promotions and Credits

Promotions, referral codes, and credits are subject to offer terms, have no cash value, and may expire. We may modify or revoke them for suspected abuse.

Intellectual Property

The Services (software, text, graphics, logos, and trademarks) are owned by Hungry Express or its licensors and protected by law.

You may not copy, modify, distribute, or create derivative works without permission.

Disclaimer

The Services are provided “as is” and “as available.” To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the extent permitted by law, Hungry Express will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

Indemnity

You agree to indemnify and hold Hungry Express harmless from claims arising out of your misuse of the Services, violation of these Terms, or infringement of third-party rights.

Termination

We may suspend or terminate access for any breach or suspected misuse.

You may stop using the Services at any time. Sections intended to survive termination (e.g., IP, disclaimers, liability, indemnity) will survive.

Changes to the Services and Terms

We may update the Services and these Terms.

We’ll post the new Terms with an updated date. Continued use after changes constitutes acceptance.

Governing Law and Disputes

These Terms are governed by the laws of Nigeria. Disputes should first be raised with Support.

If unresolved, they will be subject to the courts of Nigeria (without prejudice to any mandatory consumer rights).
